The proliferation of deepfake nudities created by AI has grown to be a significant problem, frequently resulting in abuse, exploitation, and harassment. The victims of these unconsented photos may suffer terrible psychological, social, and professional repercussions in addition to being unethical. Many campaigners and academics contend that because these actions employ people's likenesses for explicit goals without their consent, they are a type of sexual abuse. Why Sexual Abuse Is Involved Breaking Consent: Without the subject's permission, deepfake nudes are produced and distributed, infringing on their autonomy. Effects on the Mind: As with revenge porn or other image-based abuse, victims frequently suffer from trauma, anxiety, and depression.


Any child with a phone these days may launch an app and produce deepfake nudities of other kids in a matter of minutes. A few years ago, that wasn't the case, but today AI-generated nudities are appearing at schools across the United States, including those in Washington. At a  High School, a male student noticed a TikTok advertisement for a website called "nudify" last autumn. During prom, he and his classmates utilised the website to produce computer-generated nudities of "at least six 14- to 15-year-old female classmates," which they then shared on Snapchat. Because they felt they were "not required to report fake images" under the current regulation, school staff members who were aware of the artificial intelligence-generated images chose not to notify authorities. Police didn't find out until several parents reported.


The events that transpired at IHigh School are both incredibly upsetting and remarkably typical. This data point is part of a trend of schools in America, from Aledo, Texas, to Westfield, New Jersey, that have similar stories. Artificial intelligence-generated nudity is not harassment or bullying. The victim's personhood and sense of self are stolen, and they constitute a type of sexual abuse. Punishers suffer little to no repercussions when schools are ill-prepared, while victims suffer from sadness, anxiety, and shame as well as the constant fear that their photos could reappear. If nothing is done, this issue will grow too big to handle. In high school, 15% of students believe they have friends who have been the victims of AI-generated nudity.


In nations like South Korea, where this technology has gained traction more rapidly, the development of AI-generated CSAM has burst into a national disaster that has affected more than 500 schools. This catastrophe will deprive even more kids of the secure upbringing they are entitled to as it spreads throughout our neighbourhoods and schools. Our Legislature responded swiftly to the  event in Washington, and this year Governor approved a bill making AI-generated nudity illegal. However, the problem remains unresolved. Two approaches are needed to address this crisis: district-level policy and federal legislation.

Our laws at the federal level are still lagging behind this technology. Two measures are presently before Congress that would give victims their agency back. Deepfake porn would be illegal under the TAKE IT DOWN Act, which would also mandate that social media sites delete explicit AI-generated images that victims have reported. By establishing a civil remedy, the DEFIANCE Act would enable victims to seek injunctive relief to stop the circulation of pictures and obtain compensation for the suffering they have endured. Both proposals passed the Senate with a unanimous vote;  TAKE IT DOWN passed with changes. There is now a crucial chance for the House, led by House Energy and Commerce Chair Cathy McMorris Rodgers, R-Wash., to pass both legislation. To treat AI-generated nude photos as a type of sexual abuse, local school districts, such as Seattle Public Schools, need to update their sexual harassment, bullying, and codes of conduct regulations. Our consent and sexual education programs should be revised to address the negative effects of producing and disseminating AI-generated nudity in order to stop such events in the future. Lastly, incident response plans must be created by schools to guarantee that administrators discipline offenders, offer victims strong support, and know when and how to notify law enforcement and relatives.
